Stock futures little changed as Wall Street set to pause after rally

NEW YORK (Reuters) - Stock futures were little changed on Tuesday as investors awaited a batch of economic data for a confirmation that the recent rally that has taken the S&P 500 to an another record close is solid.

The Federal Open Market Committee also begins its two-day meeting on monetary policy, with results scheduled to be announced on Wednesday. A recent slew of weak growth data has raised expectations the Federal Reserve will keep its pace of bond buying at $85 billion a month.

"With earnings season coming to an end, the focus is now on what the next market driving theme is," said Andre Bakhos, director of market analytics at Lek Securities in New York.

"The economic data, the comments from ECB and FOMC could all be the drivers, an additional confirmation to justify the levels we are at now. All of these factors come to play for us to break out to a whole new territory, above 1,600 (on the S&P 500)."

S&P 500 futures fell 1.9 points and were slightly below fair value, a formula that evaluates pricing by taking into account interest rates, dividends and time to expiration of the contract. Dow Jones industrial average futures fell 3 points while Nasdaq 100 futures added 0.75 point.

The S&P 500 index ended at an all-time high on Monday as growth-oriented stocks, including energy and technology, led the way to the index's sixth rise in the past seven sessions.

A positive finish to April would deliver a sixth straight month of gains. That would be the longest winning streak since September 2009 when the index rallied for seven straight months. The broad market index is up 1.6 percent for the month.

In macroeconomic news, the U.S. employment cost index is due at 8:30 a.m. ET (1230 GMT) and the S&P/Case-Shiller home-price index for February is due at 9 a.m. ET.

The 20-city Case Shiller Home Price Index is set for another jump in February, seen rising 9 percent year-on-year from 8.1 percent in January, giving the series its fastest pace of growth since May 2006, according to a Reuters survey of analysts.

The Chicago purchasing managers' index for April will be released at 9:45 a.m. ET and the Conference Board's April consumer confidence index is due at 10:00 a.m. ET.

Financial stocks were likely to be in focus after UBS beat expectations for first-quarter profit thanks to a surge in trading income from its investment bank and more fees from wealthy clients. Strong results from banks and expectations of more central bank stimulus took European shares to a 4-1/2 year high.

On the corporate earnings front, Pfizer Inc shares were down 3 percent in premarket trade after posting lower-than-expected quarterly earnings and revenue. The largest U.S. drugmaker also trimmed its full-year profit outlook.

U.S. retailer Best Buy Co Inc retreated from its ill-fated European expansion by selling its stake in a joint venture to Carphone Warehouse Group for less than half what it paid five years ago. Best Buy shares rose more than 5 percent in premarket trade.

Justices refuse Alabama's immigration law appeal

WASHINGTON (Reuters) - The Supreme Court on Monday rebuffed the state of Alabama, and gave a win to the Obama administration, by declining to review a lower court ruling that had blocked a controversial part of the state's tough immigration law.

Alabama had asked the high court to review an appeals court decision to stop enforcement of the 'harboring' provision that made it illegal to harbor or transport anyone in the state who had entered the country illegally.

The appeals court had acted in 2012 at the Obama administration's request. The White House had said that Alabama's law was trumped by federal immigration law.

The Alabama law, enacted in 2011, is considered one of the toughest state immigration statutes in the nation. The law also made it illegal to encourage people to either enter or stay in the country in violation of federal immigration laws.

The Atlanta-based 11th U.S. Circuit Court of Appeals, in two separate decisions, upheld injunctions against the harboring provision and other parts of the law in August 2012.

A brief order issued by the court on Monday said Justice Antonin Scalia disagreed with the decision not to hear the case.

The Obama administration has challenged other provisions of the Alabama law, but they were not at issue in the case before the high court.

In 2012, the justices partially upheld a similar wide-ranging law enacted in Arizona.

Arizona and eight other states have similar laws. Laws in Georgia and South Carolina are also being challenged in court.

The case is Alabama v. United States, U.S. Supreme Court, No. 12-884.

MUFJ unit in talks to sell services to Morgan Stanley trust clients

NEW YORK (Reuters) - A U.S. unit of Mitsubishi UFJ Financial Group Inc is in talks to acquire the rights to sell trust-banking services to Morgan Stanley's clients, in the bank's latest bid to expand its business abroad, a source familiar with the matter said on Sunday.

The proposed deal involves Mitsubishi UFJ's Union Bank providing services to trust accounts worth an estimated $4 billion, which Morgan Stanley will continue to manage. Union Bank will earn fees on the trust services it sells, the source familiar with the matter said.

Mitsubishi UFJ is the Wall Street investment bank's biggest shareholder.

The proposed deal is subject to approval from the Office of the Comptroller of the Currency.

Mitsubishi UFJ could not immediately be reached for comment.

In another deal earlier this month, through UnionBanCal - Union Bank's U.S. parent - Japan's biggest bank agreed to pay $3.7 billion for a portfolio of U.S. commercial property loans from Deutsche Bank AG .

RICHMOND, Va. (AP) ? Two people close to a federal investigation of a nutritional supplements manufacturer say the FBI is examining the relationship the company and its chief executive have with Virginia Gov. Bob McDonnell and his wife.

The people asked not to be identified because their roles in the case preclude them from speaking publicly. They said Monday that the FBI began questioning people close to the McDonnells as an outgrowth of a securities probe of Virginia-based Star Scientific Inc.

They said questions have focused on gifts the McDonnells have received from company CEO Jonnie Williams. Court documents show Williams paid $15,000 toward catering for the governor's daughter's wedding in June 2011.

A spokesman for McDonnell did not immediately return messages seeking comment. An FBI spokeswoman refused to comment Monday night.

A former chef at the Virginia governor's mansion who is facing felony embezzlement charges filed court papers Monday saying he gave investigators evidence alleging lavish gift-taking and other wrongdoing involving Gov. Bob McDonnell more than a year ago.

The 13-page filing contends that fired Executive Mansion chef Todd Schneider was a whistle-blower who provided authorities with evidence in 2012 alleging that McDonnell and some relatives received gifts from the top executive of a troubled nutritional supplement maker, Star Scientific. It also alleges that he was told to take state-purchased food as payment for personal services and that others took food and supplies from the governor's mansion.

An aide to the governor said McDonnell's office had no immediate comment.

Schneider is facing four counts of taking state property worth $200 or more in the last half of 2011 and early 2012. Monday's filings came as part of a motion seeking to dismiss charges against Schneider at a hearing in the case scheduled for Thursday.

Schneider had headed the Virginia Executive Mansion kitchen operations from 2010, when McDonnell moved in, until last year, when he was dismissed after a state police inquiry began into alleged improprieties in the mansion's kitchen.

The court papers also accused Virginia Attorney General Ken Cuccinelli of prosecuting Schneider in an attempt to protect his political interests in his current campaign for governor ? "a campaign for which he needs substantial political donations and the support of the current Governor of Virginia." Both Cuccinelli and McDonnell are Republicans.

The documents claim Cuccinelli ignored the evidence because of conflicts of interest that the attorney general and McDonnell shared. The filings also state Schneider provided the evidence to the attorney general's office, the Virginia State Police and the FBI in February 2012.

Cuccinelli should have recused his office from the case a year ago when the evidence came to light and not as he did last week, the court documents stated.

Political and official aides to Cuccinelli dismissed the motion by Schneider's attorney, Steven D. Benjamin of Richmond, as an effort to sensationalize a criminal case.

Cuccinelli's campaign said in a release: "Todd Schneider is facing multiple indictments for stealing. Ultimately he will face a jury of his peers."

Brian Gottstein, spokesman for the attorney general's office, said the case "will be tried in court and not in the media."

Schneider's filing contends he gave the evidence to Cuccinelli's office before the Republican candidate for governor revealed in required financial filings that he had close ties to a Star Scientific executive, Jonnie Williams, and had owned stock in Star Scientific.

Benjamin said he noted that Cuccinelli sold 1,500 shares of Star Scientific stock at near-record prices for the stock last summer at a profit of $7,000

Schneider also alleges in the filings he told investigators that mansion staff and other state employees had witnessed Schneider being instructed to take state-purchased food as payment for personal services, and that they saw others "openly taking cases of food and other supplies from the Governor's Mansion."

The filings come amid an ongoing investigation into operations of the kitchen at the 200-year-old official home of Virginia's governors, the longest-serving gubernatorial residence in the nation.

Among the documents the motion says Schneider provided to the state police were a contract McDonnell signed with Schneider's private catering company for a daughter's 2011 mansion wedding reception and a check from Williams used to pay for the catering.

Cucinelli's top campaign adviser, Christopher J. LaCivita, called the court filing "the defense counsel's Gloria Allred moment," referring to the famous celebrity lawyer.

The Virginia State Police, in a news statement, noted its policy of neither confirming nor denying investigations of elected officials. The FBI had no immediate comment.

A hearing was scheduled for Thursday on Cuccinelli's recent motion to recuse his office from prosecuting Schneider and the ongoing state police investigation into operations at the executive mansion kitchen.

It was a surprising score. It didn't take anything away from Davis' win, but it was odd enough that Magalhaes spoke up about it.

Parliament?s Penal Code Committee to summon Sheikh Ilyas for ?misleading public? thumbnail

Parliament?s committee responsible for the new Penal Code has decided to summon Chair of Adhaalath Party Religious Council and a member of Maldives Fiqh Academy,?Sheikh Ilyas Hussein.

The committee decided to summon Ilyas on the grounds that he had made ??misleading?? comments suggesting that the purpose of the penal code was to ?destroy the religion of Islam?.

The decision was made during last Thursday?s meeting. During the meeting, Maldivian Democratic Party (MDP) MP Nazim Rashad proposed that the committee summon Ilyas to clarify doubts he may have regarding the Penal Code and to clarify how much the Penal Code incorporated the principles and penalties in Islam.

According to local media, on March 22, Sheikh Ilyas held a religious sermon dubbed ?Purpose of Islamic Shariah? at the Furuqan Mosque after Isha Prayers, and there he swore to God that the Penal Code was made to destroy the religion of Islam.

Speaking to Minivan News today, the Chair of Penal Code Committee MDP MP Ahmed Hamza said the committee had asked the parliament secretariat to send notice to Sheikh Ilyas to produce himself before the committee on Tuesday.

?He has told the public that there are some provisions in the Penal Code that are not in it,? Hamza said. ?We want to bring him in and have a chat and inform him about the provisions that are there in the Penal Code.?

Hamza said the Penal Code included provisions stating that theft and fornication were crimes.

?It also has a provision on flogging,? Hamza added.

Local media reported that during the sermon, Ilyas had declared that the Penal Code did not have penalties for fornication, theft, corruption, forgery or robbery, and if a person commits a crime while intoxicated, the person is not subject to punishment. He also claimed that according to the new penal code, it was not a crime for two people to have?consensual?sex.

Ilyas declared that the Penal Code was ?a trap made by the West? to erase Islam in the name of Muslims, and vowed that he was ready to argue the point even if all the country?s lawyers came out against him.

Sept. 11 airplane debris could have been placed deliberately, police say

Pieces of what is believed to be landing gear from one of the airliners that hit the World Trade Center on Sept. 11, 2001, was discovered wedged between two buildings in lower Manhattan.

Police say they are not ruling out the possibility that a 5-foot-long chunk of airplane debris found near the World Trade Center site, believed to be a piece of landing gear from one of the planes that hit the towers more than 11 years ago, could have been placed there deliberately.

NBC 4 New York was the first to report Friday that?the part was found wedged between two buildings in a very narrow alley only about 18 inches wide between the rear of 50 Murray St. and the back of 51 Park Place (see map at NBCNewYork.com), the site where a mosque and community center has been proposed three blocks from ground zero.

Police Commissioner Ray Kelly said there was rope intertwined in part of the gear, and there were no marks on the buildings indicating the piece hit the walls on the way down. The part bears a "Boeing" stamp, followed by a series of numbers, as seen in an exclusive photo obtained by NBC 4 New York (see below).

Kelly visited the alley Friday evening and viewed the debris from about 30 feet away. He described the piece as being about 5 feet by 4 feet by 17 inches, lying in a "very, very narrow, confined area."?

"Somehow the part gets down there," Kelly said. "Could it have been lowered at some time, it's possible."

Still, Kelly said he was not surprised to see such a large plane part anchored in such a tight area.

"If you see how confined this space is, and you realize the chaos that existed down here on this street, it's not surprising," he said. "No cleanup went on in this 18-inch space between these two buildings."?

The NYPD said the landing gear was found after surveyors hired by the property owner inspecting the rear of 51 Park Place called police on Wednesday. See below for a map.

Police spokesman Paul Browne said the NYPD has?secured the location "as it would a crime scene," and investigators are photographing the scene and restricting access until the medical examiner completes a health and safety evaluation.

Officials said the soil below the piece of debris could also be searched for remains.?

Police officials say the part could be difficult to remove, and may require demolition work that would destroy the two surrounding buildings. Officials are expected to be back at the scene on Monday to see if it can be removed.

"It really is a historical artifact," Kelly said.

When plans for the Islamic center at 51 Park Place were made public in 2010, opponents said they didn't want a mosque so close to where Islamic extremists attacked. They argued the site was "sacred" because landing gear from one of the hijacked Boeing 767 jets had punctured the roof of the building on Sept. 11.

During street protests, they clashed with supporters of the center, who said it would promote harmony between Muslims and followers of other faiths.

The building includes a Muslim prayer space that has been open for three years. After protests died down, the center, called Park51, hosted its first exhibit last year. The space remains under renovation.

Mohammed Fekonus, who prays inside the mosque at Park51 and whose son was a Stuyvesant High School student who ran from the dust cloud on Sept. 11, is convinced discoveries like the plane part could be endless.

"We were all emotionally distressed by that event," he said.

"If you really want to look for things, we'll find things 100 years from now."?

Donna Marsh O'Connor, who lost her daughter Vanessa Lang Langer in the attacks and is a member of September 11th Families for a Peaceful Tomorrow, called the landing gear discovery "bizarre."

O'Connor is a supporter of the Islamic center and said the fact that the plane fragment was found there "makes me think that this was the right place for a center that was going to heal the divide."

The name Boeing and a serial number is visible on what is believed to be a piece of land gear from one of the commercial airliners destroyed on Sept. 11, 2001. The piece was discovered wedged between two buildings in lower Manhattan.

In a statement, Sharif El-Gamal, the president of Soho Properties, which owns 51 Park Place, said workers called the city and the police as soon as they discovered the landing gear. He said the company is cooperating with the city and the police to make sure the piece of equipment "is removed with care as quickly and effectively as possible."

Patricia Riley, whose sister Lorraine Riley was killed in the Sept. 11 attacks, called the landing gear discovery "very strange."

"Twelve years later we are still finding remnants of the attack on our country," she said. "... For years to come we'll continue to find things that we didn't see before. Hopefully, they'll serve as a reminder that we have to stay vigilant."

The Park51 space, a former Burlington Coat factory, is a five-story, mildly run-down building. Renovations are expected to take years and would add an auditorium, a pool, a restaurant and culinary school, a child care facility and artist studios.

On Sept. 11, American Airlines flight 11 hit the north tower at 8:46 a.m., and United flight 175 hit the south tower at 9:03 a.m.

The rubble from the 9/11 attack was cleared from the 16-acre site by the spring of 2002. Other debris, including human remains, has been found scattered outside the site, including on a rooftop and in a manhole, in years since.

Boeing declined comment.

Stocks stall on tepid GDP growth

Stocks?stalled Friday after GDP didn't grow as much as hoped and earnings from a handful of big companies failed to rev up investors.?Weaker hiring reports have also held stocks back.

The?stock?market stalled Friday after the U.S. economy didn't grow as much as hoped and earnings from a handful of big companies failed to rev up investors.

The economy grew at a 2.5 percent annual rate in the first three months of the year, the government said. That was below the 3.1 percent forecast by economists.

The shortfall reinforced the perception that the economy is grinding, rather than charging, ahead. Investors have also been troubled by reports in the last month of weaker hiring, slower manufacturing and a drop in factory orders. Many economists see growth slowing to an annual rate of around 2 percent a year for the rest of the year.

U.S. government bonds, where investors seek safety, rose after the report.

"There are some concerns as we head into the summer," said JJ Kinahan, chief derivatives strategist for TD Ameritrade. "In the last three weeks, we've have seen numbers that weren't exactly what you'd love to see."

Corporate earnings this week have also contained worrisome signs. Many companies missed revenue forecasts from financial analysts, even as they reported higher quarterly profits. For example, Goodyear Tire slipped 3.3 percent to $12.51 Friday after revenue fell short of analysts' estimates, hurt by lower global tire sales.

Of the companies that have reported earnings so far, 70 percent have exceeded Wall Street's expectations, compared with a 10-year average of 62 percent, according to S&P Capital IQ. However, 43 percent have missed analysts' revenue estimates. Just over half of the companies in the S&P 500 have reported quarterly results.

The S&P 500 index dropped 2.92 points, or 0.2 percent, to close at 1,582.24.

The Dow rose 11.75 points, or 0.1 percent, at 14,712.55. The index got a big lift from Chevron. Profit for the U.S. oil company beat expectations of financial analysts in the first quarter, pushing shares up 1.3 percent to $120.04.

Three?stocks?fell for every two that rose on the New York?StockExchange.

Both indexes were up for the week and remain slightly below their all-time highs reached April 11. The Dow index rose 1.1 percent this week while the S&P gained 1.7 percent.

The market has been bolstered by the Federal Reserve's easy money policy. The disappointing growth figure for the economy will ensure that the Fed sticks with its stimulus policy, providing a support for?stocks, said Peter Cardillo, chief market economist at Rockwell Global Capital.

"The economic data that we've been getting points to no early exit for the Fed's stimulus," Cardillo said.

The Nasdaq composite fell 10.72 points to 3,279.26, a decline of 0.3 percent. The index is still 2.3 percent higher this week.

The tech-heavy index has lagged the Dow and the S&P 500 this year, but it led the way higher this week, boosted by Microsoft. The software giant, which makes up 5.3 percent of the Nasdaq, recorded its biggest weekly gain since January last year, 6.8 percent, after reporting earnings April 19 that beat Wall Street's expectations. The company also rolled out an aggressive push into the computer tablet market.

Even Apple, the largest?stock?in the Nasdaq, had a good week. Apple rose 6.8 percent to $417.20, its best weekly gain since November, despite posting a decline in quarterly profit Tuesday. Apple accounts for 7.6 percent of the Nasdaq composite.

Among other big names investors were focusing on, Amazon.com fell 7 percent to $254.81 after the company warned of a possible loss in the current quarter. The online retailer also reported lower income for the first quarter as it continued to spend heavily on rights to digital content. Expedia fell 10 percent to $58.56 after the online travel company reported a quarterly loss.

Homebuilder D.R. Horton surged 8.7 percent to $26.66 after its income nearly tripled thanks to a continuing recovery the housing market. The results handily beat the forecasts of financial analysts who follow the company.

J.C. Penney jumped 12 percent to $17 after the billionaire financier George Soros disclosed that he had taken a 7.9 percent stake in the struggling company.

In government bond trading, the yield on the 10-year Treasury note slipped to its lowest rate of the year, 1.67 percent, from 1.71 percent the day before. The yield has fallen from 2.06 percent six weeks ago as traders move money into lower-risk investments.

The dollar weakened against the euro.

The European currency bought $1.3029 at the end of day, compared with $1.3002 the day before. The ISE dollar index, which measures the U.S. currency against a group of other world currencies including the Japanese yen and the euro, dropped 0.3 percent, to 82.48.
